Well water is nothing more than groundwater that is found below the soil surface in the saturation zone and in direct contact with the soil or subsoil. These waters, in turn, can be called natural mineral waters, since they are microbiologically healthy and their origin is found in a stratum or underground deposit, which spring from a spring or can be captured artificially by means of a borehole, well, ditch or gallery. or, the combination of any of them, distinguishing itself from the remaining ordinary drinking waters: (i) Due to its nature, characterized by its content of minerals, trace elements and other components and, sometimes, by certain effects. If it is a new collection in an aquifer different from the one that had been used, a new declaration file must be initiated. Immediately afterwards, the competent authority will comply with the procedure established in the Mining Law, requesting the appropriate reports. In view of the actions carried out, the water object of the request will be declared as natural mineral water or spring water, as appropriate. Said declaration, duly reasoned, must be published in the Official State Gazette and in the Official Gazette of the corresponding autonomous community. Once the water declaration is published, the request for authorization to use the underground catchment will be made to the competent mining authority of the corresponding autonomous community. Finally, the competent health authorities of the autonomous communities will notify the Spanish Agency for Food Safety and Nutrition of the cases in which the recognition of natural mineral waters has been granted or withdrawn. (ii) Regarding the obligations of the operators of the food business (packaging and distribution industries). Packaging and distribution industries, in general, will ensure that the relevant hygiene requirements are met at all stages of the production, processing and distribution of food under their control. If during exploitation it is found that the natural mineral water is contaminated and does not have the necessary biological characteristics, the natural or legal person carrying out the underground collection must immediately interrupt the activity, especially the packaging, until it has been eliminated.
